european authorized representative (EU AR), is a natural or legal person designated by a manufacturer located outside the European EconoMIC Area (EEA, including the EU and EFTA). This individual or entity acts on behalf of the non-EEA manufacturer to fULfill specific responsibilities requiRED by EU directives and laws.

 

Why Do You Need an eu authorized representative?

To ensure the safety of products sold within the EU and to guarantee that imported products bearing the CE mark comply with EU laws on consumer, property, and environmental protection, EU regulations require non-EU manufacturers to:

01. Appoint an EU Authorized Representative

Non-EU manufacturers must appoint an EU Authorized Representative (AR) established within the 30 member states of the EU + EFTA. The AR acts on behalf of the non-EU manufacturer in dealings with governmental authorities and institutions across these countries.

 

02. Display the AR on Packaging

Products imported from outside the EU and bearing the CE mark must clearly display the name and address of the EU Authorized Representative on the packaging, label, and user manual.

 

03. Maintain Technical Files

The EU Authorized Representative must keep the latest Technical Filesfor all CE-marked products. According to EU law, these files must be readily available for inspection by EU authorities. After the last batch of products is placed on the market, the files must be retained by the AR for at least five years.

 

04. Establish an Incident Prevention & Monitoring System

Non-EU manufacturers must establish an effective system in the EU to handle product incidents. The EU AR assists with reporting, notifications, and recalls of products.

 

Responsibilities of an EU Authorized Representative

- Familiarity with local regulations.

- Ability to assist the manufacturer in resolving compliance issues when they arise.

 

Which Products Require an EU AR?

Any product that requires a CE mark must have an EU AR. Products include:

 

- Toys

- Electronics

- Personal Protective Equipment (PPE)

- Machinery

- Construction products

- Gas appliances

- Leisure and private boats

- Pressure equipment

- Measuring instruments

 

Note:Except for medical devices, civil explosives, and certain lifts and cable cars, all CE-marked products are subject to this regulation.

How to Apply for an EU AR

The following entities can act as an EU AR:

 

1. Manufacturer or brand established in the EU.

2. Importer established in the EU.

3. Authorized representative established in the EU, designated in writing by the manufacturer or brand.

4. Distribution service provider established in the EU.

 

Tip:If an exporting company has no manufacturer or importer within the EU, it is recommended to find a suitable EU AR in the market. JJR LAB can provide one-stop services including CE certification and EU AR services.

 

Consequences of Not Appointing an EU AR

1. Notified bodies must appoint an EU AR before issuing a ce certificate.

2. Products placed on the EU market must display the AR on the packaging.

3. Without an EU AR, products may be detained by customs.

3. Packaging legal certificates and weee registration numbers for all AR-handled products.
