On February 6, 2023 (U.S. local time), the FCC officially released document FCC 22-84, which came into effect immediately upon publication. This document primarily strengthens device authorization to prevent security threats to the United States and restricts devices and content listed on the Covered List. According to Section 2.911(d)(7) of KDB 986446, applicants must designate a contact located in the United States to act as the applicant’s agent, regardless of whether the applicant is a domestic or foreign entity. Applicants located in the U.S. may designate themselves as the agent for service of legal documents.
The new FCC requirements are similar to the Canadian representative requirements under ised deviCE certification.
To apply for FCC ID certification, the following requirements must be met:
1. The first certification attachment is a statement from the applicant confirming that the certified device is not listed on the Covered Equipment List and that the applicant is not on the Covered Applicant List. This statement consists of two separate declarations, both of which must be kept as independent letters rather than combined.
2. The second statement is the designation of a U.S. agent for service of process. According to KDB and Section 2.911(d)(7), the applicant must designate a contact located in the United States to act as the agent for service of legal documents, regardless of whether the applicant is a domestic or foreign entity. Applicants located in the U.S. may designate themselves as the agent for service of legal documents. This new FCC role is similar to the Canadian representative role required by ISED Canada for device certification.
