Sellers must comply with Extended Producer Responsibility (EPR) requirements to ensure product compliance and avoid violation risks.

What is EPR?

EPR stands for Extended Producer Responsibility.

It is an environmental policy requirement set by the European Union (EU).

Based on the “polluter pays”principle, EPR requires producers to REDuce the environmental impact of their products throughout their entire lifecycle.

Producers are responsible for the fULl lifecycle of the products they place on the market — from design and production to waste management and disposal.

In general, EPR aims to prevent and reduce the environmental impact of product packaging, packaging waste, electrical and electronic equipment (EEE), and batteries, thereby improving environmental quality.

Legal Basis for Spain’s EPR

Main Regulations:

- Law 7/2022– Waste and Contaminated Soils for a Circular Economy

- Royal Decree 1055/2022– Spanish Packaging Law

- Royal Decree 110/2015– Spanish WEEE (Waste Electrical and Electronic Equipment) Law

- Royal Decree 106/2008– Spanish Battery Law

Requirements:

- Producers must register with MITECO(Ministry for the Ecological Transition and the Demographic Challenge of Spain)

- Obtain an EPR Registration Number (Número de Registro)

- Periodically declare product data and pay environmental fees

Product Categories Covered

Currently, platforms like TEMUand Amazonmainly involve the following categories:

- Packaging:product boxes, shipping cartons, labels, tapes, etc.

- Electrical and Electronic Equipment (EEE):household items, lamps, extinguishers, light bulbs, solar panels, etc.

- Batteries:portable batteries, automotive batteries, industrial batteries

Who Needs to Register?

If you sell the above-mentioned categories of products to Spain,

you are required to complete the relevant EPR registration and fulfill ongoing EPR obligations.

Steps for Merchant Compliance

1. Obtain a Spanish VAT Number

2. Choose an appropriate compliance method:

 - Self-registration and reporting

 - Through a third-party service provider

 - Appoint a Spanish Authorized Representative

3. Collaborate with a Producer Responsibility Organization (PRO):

 Complete registration and submit periodic declarations.
