Amazon US and Canada Sites Toy Compliance Requirements

Recently, Amazon's US and Canada marketplaces have introduced new compliance requirements for projectile toys and magnetic water beads in the children's toy category. Sellers are advised to take prompt action by uploading relevant compliance documentation to the Amazon Seller Central platform according to the categories they sell.

Amazon US Definition

Children's toys refer to products intended for use by children aged 12 years or younger for learning or play.

 

The following criteria determine whether a product qualifies as a "children's toy":

- Age grading on the product's packaging indicates the toy is intended for children aged 12 years or younger.

- The product's packaging, display, promotion, or advertising suggests it is suitable for children aged 12 years or younger.

- Consumers typically perceive the product as being for children aged 12 years or younger.

 

Prohibited Items on Amazon (including but not limited to):

- Abrasive kite strings

- Beaded and amber teething jewelry

- Bead clips and bead chains

- Mushroom-shaped baby teethers or pacifiers

- Non-toy magnetic products

- Magnetic pens

- High-powered magnets

- Dart spinner fidget toys

- Toothpick crossbows

- Water beads

 

RegULatory Standards

Compliance with the following is required:

- Consumer Product Safety Improvement Act (cpsia) (Lead, Phthalates)

- Section 14(a)(5) of the Consumer Product Safety Act (CPSA) (Tracking Labels)

- Title 16 CFR Part 1501 (Small Parts Regulations)

 

Additionally, compliance with one of the following (if applicable):

- ASTM F963-23 or astm f963-17 Consumer Safety Specification for Toy Safety

 

> Note: Children's toys manufactured after April 20, 2024, must comply with ASTM F963-23 standards.

 

Documentation Submission Requirements Documents:

- Test reports issued by a CPSC-accredited laboratory demonstrating compliance with the above standards and regulations.

- A Children’s Product Certificate (CPC).

- Test reports or product images confirming compliance with Section 14(a)(5) of the CPSA (Tracking Labels).

 

> Note: All documents, test reports, or certificates provided to Amazon must be authentic and in their original format (unaltered).

 

Images:

- Model number, part number, or product number.

- Name and address of the manufacturer, importer, distributor, or authorized representative.

- Product labels.

- Registration card.

- Compliance markings.

- Hazard warnings.

- Product manuals and instructions.

- CPSA tracking labels.

 

> Image Submission Notes:

- Images must be clear and legible.

- They must verify that the product is identical to the tested item and matches the product detail page on Amazon.

- Manuals, safety information, labels, and warnings must be in the language of the target sales region.

- For bundled or multi-pack items, images for each included product must be provided.

- sor/2011-17 (Toys Regulations)

- SOR/2016-188 (Phthalates Regulations)

- SOR/2016-193 (Surface Coating Materials Regulations)

- SOR/2018-83 (Lead Content Regulations for Consumer Products)

- Section 3 of SOR/2011-17 ("Official Languages - English and French Requirements")

 

> Note: All children's toys must include safety warnings and instructions in both English and French.

- Test reports issued by an ISO 17025-accredited laboratory demonstrating compliance with the above standards and regulations.

 

> Note: All documents, test reports, or certificates provided to Amazon must be authentic and in their original format (unaltered).

 

Images:

- Model number, part number, or product number.

- Name and address of the manufacturer, importer, distributor, or authorized representative.

- Product labels.

- Compliance markings.

- Hazard warnings.

- Product manuals and instructions.

 

> Image Submission Notes:

- Images must be clear and legible.

- They must verify that the product is identical to the tested item and matches the product detail page on Amazon.

- Manuals, safety information, labels, and warnings must be in the language of the target sales region.
