Recently, TEMU, following Turkey’s requirement for a Turkish authorized representative, has introduced another major new regULation.

 

The new regulation states that U.S. market regulation and consumer protection require a "U.S. Representative." To ensure that children's products can be sold in the United States, CPC certificates must include U.S. representative information by March 31.

 

Starting in April, if historical cpc certificates for products do not have updated U.S. representative information, those products may be removed from the U.S. site.

What is CPC Certification?

Children’s Product Certificate (CPC certification).

 

It is a certification requiRED by the U.S. Consumer Product Safety Commission (CPSC) for all children's products entering the U.S. market. This document serves as proof that the product complies with relevant U.S. safety regulations for children's products.

 

It is worth noting that since the beginning of this year, not only has TEMU strengthened its review of CPC certificates, but Amazon has also tightened CPC certification reviews. Many sellers have had their products removed due to missing CPC certificate information reports.

 

What is a U.S. Representative?

A U.S. representative, similar to an EU responsible person (EU Rep), is officially called a United States Authorized Representative. It refers to a U.S. agent that foreign entities must designate when engaging in manufacturing, preparation, propagation, compounding, or processing imported equipment in the U.S. market.

 

U.S. Representative Registration Requirements:

1. Business Premises: The U.S. representative must have a commercial business location in the United States and be able to answer phone calls or receive mail during normal business hours.

2. Contact Information: The U.S. representative's contact information must be valid and accurate to ensure that U.S. regulatory authorities can REACH them in a timely manner.

 

Which Products Require a U.S. Authorized Representative?

Including but not limited to the following:

 

1. Medical devices

2. Cosmetic products

3. Pharmaceutical products

4. Durable infant products

5. Environmental protection-related products

 

How to Add U.S. Representative Information to a CPC Certificate?

1. Apply for a U.S. authorized representative.

2. Submit application materials and sign a representative agreement.

3. Add U.S. representative information to the CPC certificate, including name, address, and phone number.

 

What Are the Risks of Not Providing U.S. Representative Information?

Failure to provide U.S. representative information may result in the following:

 

- Goods being detained by customs

- Legal action, fines, or a sales ban

- Restrictions on store operation rights
