Compliance Requirements for Selling Electronic and Electrical Equipment in the UK

 

To sell electronic and electrical equipment in the UK market, you must comply with a range of regulations related to product safety, electromagnetic compatibility (EMC), and the restriction of hazardous substances. When selling on platforms such as Amazon, eBay, and Temu, it is essential to ensure that products fully comply with all applicable laws and platform policies.

 

Recently, Temu has updated its compliance guidelines for electronic and electrical products sold to the UK. This article provides a summary of the UK site's compliance requirements to help sellers understand and meet these standards.

 

1. Regulatory Requirements and Manufacturer Obligations

The UK has specific regulations for electronic and electrical products. The list below includes key obligations, but it is not exhaustive. Additional specific regulations may apply depending on the nature and use of the product.

 

According to the UK Government's guidance on the ukca marking: Roles and Responsibilities, manufacturers must fulfill the following obligations before placing a product on the Great Britain market:

 

1. Ensure Product Compliance

 Ensure the product meets all applicable UK regulations and designated standards. The product must be designed and manufactured in accordance with essential regulatory requirements.

 

2. Conduct Conformity Assessment

 Choose the appropriate conformity assessment procedure (self-assessment or mandatory third-party assessment) to ensure the product passes relevant testing and evaluation.

 

3. Prepare Technical Documentation

 Compile and retain technical documentation to demonstrate product compliance. This includes information about product design and manufacturing and must typically be kept for 10 years (or as specified by applicable law).

 

4. Provide a Declaration of Conformity

 The declaration must include manufacturer details, product identification, relevant laws and regulations complied with, and the notified body (if applicable) that conducted the conformity assessment.

 

5. Affix the UKCA Marking

 Once compliance is confirmed, affix the UKCA marking clearly and indelibly on the product or its packaging.

 

6. Product Labeling Information

 The product must include the manufacturer’s name, registered trade name or trademark, and postal address. It must also show identifying information such as model, batch number, or serial number.

 

2. Temu’s Compliance Guidelines

Temu is committed to providing safe, lawful, and compliant products. The platform prohibits the listing or sale of any illegal, unsafe, or high-risk products that may cause personal injury or property damage.

 

Prohibited Products (Including but Not Limited To):

1. Unsafe Products

 Including items recalled or flagged in UK safety notices, immersion heaters, car seat heating pads, universal chargers, etc.

 

2. Products with Counterfeit Certifications or Labels

 

3. Used Electrical or Electronic Equipment

 

4. Products Violating the 2012 RoHS Regulations

 e.g., products with excessive lead content.

 

5. Electronics Intended for Illegal Purposes, such as:

 

l  Police radar or traffic signal jammers

l  Devices interfering with legal radio communications (e.g., GPS jammers)

l  Hacking or surveillance devices

l  Unlocking/jailbreaking devices (e.g., phones with removed/altered IMEI)

l  Theft-related devices (e.g., wireless key programmers)

l  Military/police gear (e.g., radar detectors, police lights)

l  Illegal radio transmitters

l  Copyright-infringing devices (e.g., DVD duplicators, emulators)

 

6. Signal Boosters/Repeaters, 3G-Only Phones

 

7. Laser Products

 Including Class 3B/4 lasers, power >1mw, Type 303 laser pens

 

8. Traditional Lighting Devices

 e.g., incandescent and halogen bulbs

 

9. Large Smoke Detectors in Fire Safety Equipment

 

10. E-Cigarettes & Accessories, Equipment for Explosive Environments

e.g., explosion-proof phones/tablets

 

11. Financial Devices, such as:

 

1. POS machines with card-swipe functions

2. Devices claiming acquiring capabilities

3. POS machines showing logos of card organizations/banks

4. Credit card readers or magnetic stripe readers

 

3. Product Advertising Compliance

Sellers must ensure that product information is truthful, accurate, and complete. Misleading descriptions must be avoided. Sellers should ensure:

 

1. Products are listed in the appropriate category

2. Product information is consistent across listings

3. Usage and product-related information are clearly and truthfully described

 

4. Product Labeling Requirements

Products sold in the UK must include the following label information:

 

1. Product Identification: Model number, batch number, serial number (e.g., “Batch number: XXXXXX”)

2. Manufacturer Information: Manufacturer’s name, registered trade name/trademark, and postal address

3. Compliance Mark: UKCA marking indicating compliance with UK regulations

All label information must be clearly legible, durable, and in English.

 

5. Compliance Documentation Requirements

01 UK Authorised Representative (UK Rep)

Products bearing the UKCA mark must have a UK-based authorised representative. This representative acts on behalf of overseas sellers in fulfilling regulatory obligations and liaising with UK authorities. The seller must upload the representative's information on platforms like Amazon, eBay, and Temu, and include this information on the product packaging or accompanying documents.

 

02 UK Energy Label

The UK enforces mandatory energy labeling regulations for high-energy-consuming appliances (e.g., refrigerators, washing machines, monitors, lighting). Labels must display energy efficiency ratings and consumption details.
