What is California Proposition 65?

Products must comply with the "Safe Drinking Water and Toxic Enforcement Act of 1986," also known as California Proposition 65. The purpose of Proposition 65, enacted in 1986, is to protect drinking water sources from contamination by chemicals known to cause cancer, birth defects, or other reproductive harm. Businesses operating in California must provide warnings to consumers if their products contain or expose users to any of the approximately 900 listed chemicals.

 

Why is compliance with Proposition 65 important?

The list of harmful chemicals is extensive and frequently updated. Regardless of whether a product is already widely sold or newly launched, companies must verify compliance with legal requirements before entering the California market. Violations may result in civil penalties of up to $2,500 per violation per day.

Testing Items / Regulatory Requirements

Testing plans are recommended based on the product category and material type, commonly including lead, cadmium, phthalates, and BISphenol A (BPA), among others.

 

To meet Proposition 65 requirements, companies must provide warnings for listed chemicals unless they can demonstrate that the chemical poses “no significant risk” of cancer or “no observable effect” for birth defects or reproductive harm.

 

California Proposition 65 Testing Process:

1. Submit a testing application;

2. Prepare testing documents (product manual, parts list, testing application form);

3. Product testing;

4. A test report will be issued upon passing.

 

Documents Required for California prop 65 certification:

1. Provide 2–3 sets of samples;

2. Product user manual;

3. Bill of Materials (BOM);

4. Certification application form (provided by us).
