The EU GPSR regulation will be fully enforced on December 13, and there is only one month left before this important date. Currently, Amazon, AliExpress, TEMU, Alibaba International Station, SHEIN and other platforms have strictly ordered sellers to follow the EU agency compliance requirements, emphasizing that all sellers must apply for EU agency before all products can be sold in the European market. This regulation not only affects whether the products can enter the European market smoothly, but also directly affects the sellers' vital interests.

Amazon: Verify by ASIN.

ASIN is the unique identifier of each product on the platform. When registering with the EU agent, sellers must ensure that each ASIN sold has been accurately registered. For ASINs that are missed in the registration, Amazon will urge sellers to communicate with the authorized representative immediately and submit the necessary materials to complete the registration procedures.

TEMU: Verify by store.

TEMU conducts a comprehensive and strict review of the overall qualifications, business conditions and compliance of sellers’ stores. Previously, TEMU has taken action to verify the validity of the agreement with the European agent through email. Overdue or invalid feedback will result in the failure of the agent review and the removal of related products from the European market. The purpose is to pre-screen the compliance of the European agent and eliminate the existence of "illegal European agents".


 

AliExpress: Verify by store.

AliExpress sellers must not only complete the EU agent registration, but also ensure that all ASINs in the store have been filed and are consistent with the EU agent information. AliExpress will regularly review the store information to verify the authenticity of the EU agent registration.

[Sellers need to be wary of non-compliant operations]

 

1. Choose an unqualified European agent

From the definition of the responsible person in the EU, it can be seen that the threshold for eu authorized representatives is low but the risks are high. In order to save costs or pursue convenience, some sellers choose shell companies in the EU as their EU representatives.

 

These shell companies often have no fixed office location or contact information, and are only virtual. Once there is a problem with the product, these so-called "responsible persons" disappear, leaving the sellers who have entrusted them in trouble. For example, if goods stored in the EU need to be urgently moved out of the warehouse, the invalid EU agency information needs to be replaced, and the original labels need to be torn off, which is time-consuming and labor-intensive for the sellers and causes huge losses.

 

2. Fill in false EU agent information

In order to meet the platform's requirements, some sellers randomly found a European customer's address and filled it in the EU responsible person information. Once this practice is discovered by the platform or relevant EU agencies, the seller will face severe penalties. The platform may directly impose a ban or restriction on sales, while relevant EU agencies may further pursue the seller's legal liability.

 

3. Improper labeling operation by OD

EU labeling is one of the necessary conditions for products to enter the EU market. However, some sellers do not do it properly when labeling, resulting in the products being detained by EU customs.

Common mistakes include not showing the importer's company name and address on the product label, and not showing the product brand, product name and model. These non-compliant labeling operations will make EU customs doubt the compliance of the product and conduct further investigations.

The full name of EU Authorized Representative is to perform specific duties required by EU directives and laws on behalf of the seller. If customers, customs or the EU government have questions, they can directly contact the EU Authorized Representative for communication and processing. The EU Authorized Representative needs to review and collect relevant "technical compliance documents" and provide assistance for product accident reports, notifications, recalls, etc.

 

If the seller makes a wrong choice, he or she may face serious consequences such as huge fines, product removal, and store closure.
