Introduction to UK Authorized Representative

A UK Authorized Representative (UK Authorised Representative, often abbreviated as "UK Rep") is a natural or legal person explicitly designated by a manufacturer based outside of the UK. Similar to the role of an eu authorized representative, this individual or entity can represent the manufacturer outside the UK to fulfill specific responsibilities required by UK regulations and directives.

 

Functions of a UK Authorized Representative

1. After obtaining ukca certification, the product packaging must display the ukca logo along with the UK Authorized Representative's name and address. This ensures traceability, signifying that the product meets safety standards. If any issues arise from customers, customs, or UK government authorities, they can directly contact the UK Representative for inquiries or resolutions.

2. During the certification process, as mandated by directives, manufacturers must prepare a complete English Technical File (TCF). This document must include over ten items such as risk analyses and essential requirement checklists, as required by law.

3. Establish an incident prevention and monitoring system. Manufacturers outside the UK should set up an effective "incident prevention and monitoring system" within the UK through their authorized representative (UK Rep) to handle product incident reporting, notifications, and recalls.

 

Consequences of Not Registering a UK Authorized Representative

1. According to the new EU goods safety regulations ("Market Surveillance Regulation (EU) 2019/1020"), it is illegal to sell CE-marked products in the EU without a representative located within the EU after July 16, 2021.

2. Per official Amazon notifications, selling CE-marked products without relevant EU Representative information from July 2021 onwards is considered a violation of regulations.

3. Consequences may include goods being detained, product listings removed, and category approvals denied.

 

Who Needs a UK Authorized Representative?

1. Sellers offering products within the UK market.

2. Sellers whose products fall under the scope of UKCA certification.

3. Sellers whose products are manufactured outside the UK.

 

UK Authorized Representative Labeling Requirements

Products imported from outside the UK and labeled with the UKCA mark (or CE mark during the one-year transition period) must clearly display the UK Authorized Representative's name, address, and other relevant details on the product packaging, labels, and instruction manuals.

These details must be easily identifiable, durable, and affixed securely on the product or packaging (e.g., through printing or engraving).

 

Registration Process for a UK Authorized Representative

1. Fill out the UK Authorized Representative application form and submit the required documentation.

2. Review the manufacturer's technical files.

3. Sign and return the UK Representative Agreement.
