What Compliance Issues Should You Pay Attention to When Selling on TEMU?

In recent years, TEMU has been expanding rapidly in overseas markets. However, to further enhance product quality, the platform has been gradually implementing stricter compliance regulations.

 

Ensuring compliance is crucial for legally selling products on TEMU. This guide compiles compliance requirements for the European and North American markets, allowing sellers to review and verify their compliance status.

Compliance Requirements for the European Market

The European Union (EU) has stringent product certification requirements. To legally sell in the EU, sellers must comply with various certification regulations.

 

TEMU Compliance Requirements

EPR Registration (Extended Producer Responsibility):

EPR is an EU environmental policy that includes WEEE, Packaging Law, and Battery Law. Different categories require different registrations. Currently, TEMU mandates EPR compliance in Germany, France, Spain, and Austria. Failure to register may result in withheld payments, product delisting, or frozen funds.

 

EU Representative (EU Rep):

A natural or legal entity that represents non-EEA manufacturers in fulfilling EU regulatory and legal obligations.

 

UK Representative (UK Rep):

A legally designated representative in the UK responsible for ensuring manufacturers comply with UK regulations.

 

EU Energy Labeling:

EU regulations require energy efficiency labels on certain products, displaying energy consumption and resource usage.

 

CE certification:

The CE mark is mandatory for electronic and electrical products sold in the EU. It serves as a "passport" for market entry.

 

ukca certification:

The UKCA mark is a mandatory certification for products entering the UK market, similar in importance to CE certification.

 

ROHS certification:

RoHS (Restriction of Hazardous Substances) is part of CE certification, regulating harmful substances in electrical and electronic equipment.

 

RSL Report:

The Restricted Substances List (RSL) helps manufacturers and retailers ensure their products comply with evolving regulations and standards.

 

CE-EN71 Certification:

This is the European toy safety standard, required for all toy products sold in the EU.

 

CE-Battery Certification:

Batteries must undergo a conformity assessment before entering the European market and display the CE mark. Regulations govern battery coding and hazardous substances, and non-compliant products will be removed.

 

Compliance Requirements for the North American Market

FCC Certification (USA):

TEMU has announced stricter enforcement of FCC/CE certification and labeling for products sold in the U.S. and European markets.

 

UL Report (USA):

Electronic products must obtain a UL test report from a laboratory accredited under ISO17025/ILAC ISO 17025 standards.

 

CPC Certification (USA):

Children’s toys must have a Children’s Product Certificate (CPC). Additionally, infant and toddler products require:

- CPC certification (USA)

- CE-EN71 certification (EU)

- FDA food contact testing report

- CPSIA report

 

BQB (Bluetooth Qualification Body) Certification (USA):

Required for products with Bluetooth features. If uncertified, use "Wireless" or "BT" instead of "Bluetooth" in titles and images.

 

Embedded Battery Product Certification:

Products with built-in batteries must meet EC/EN62133 or UL2054/UL1642 standards and provide a temperature test report.

- EC-emc certification (low-voltage/USB power products)

- EU: CE-LVD certification

- Japan: pse certification

- USA & Mexico: fcc id certification

- EU: CE-RED certification

- Japan: TELEC certification

- Canada: ised certification

- North America: CPC certification

- EU: CE-Toy certification
