Important Considerations for EU CE Certification Under the gpsr Directive

Recently, Amazon launched new features to help sellers more easily comply with the General Product Safety Regulation (GPSR) in Europe. GPSR is a safety regulation for the EU market that will replace the General Product Safety Directive.

 

GPSR will be mandatory from December 13, 2024 (local time). Most non-food consumer goods sold in the EU and Northern Ireland (including CE and non-CE products) must comply with this regulation. Brand sellers can upload responsible party and manufacturer information for all products (including CE and non-CE products).

 

Note to Sellers: GPSR is not the same as an authorized representative (EU rep). An EU rep is just one compliance requirement under GPSR, which also has labeling requirements for information such as the manufacturer, importer, product safety information, and warnings.

 

Many sellers are still confused about this regulation. What compliance requirements must sellers meet?

 

Which Sellers Are Affected by This Regulation?

First, most Amazon Europe sellers will be affected! If a seller meets the following criteria:

1. Selling goods in the EU and Northern Ireland

2. Selling non-food consumer goods

 

They must comply with this regulation by December 13, 2024 (local time). (Note: GPSR does not apply to England, Scotland, and Wales.)

 

Impact on Sellers

If products do not meet GPSR requirements, Amazon will remove them after the regulation takes effect. Sellers should act quickly to avoid potential risks.

 

Should You Wait Until December to Comply?

No, GPSR has many requirements, including strict documentation and labeling requirements. If FBA inventory does not meet labeling requirements after December 13, Amazon may remove the products and inventory. Compliance can take at least 4-6 months, so start preparing now to avoid last-minute issues.

 

How to Achieve Compliance

1. Ensure all products sold in the EU & Northern Ireland meet existing labeling and traceability requirements.

2. Provide an EU responsible party for all products sold in the EU & Northern Ireland.

 

Ensure Product Labels Include the Following Information

1. Contact information for the EU responsible party (postal address and email address/URL).

2. Warnings and safety information (in the language of the sales/region).

3. Product name, brand, type, batch or serial number, or other product elements.

4. Postal address and email address/URL for the manufacturer and importer (if applicable).

5. Testing certification marks (CE/UKCA marks, etc.), EPR marks (German Packaging Act, WEEE, Battery Act, etc.), and lighting efficiency labels (for lighting products).

 

Ensure Product Detail Pages Display the Following Information

1. Name and detailed contact information for the EU responsible party, including postal address and email address/URL.

2. Name and detailed contact information for the manufacturer, including postal address and email address/URL.

3. In addition to mandatory labeling and marking information, warnings and safety information must also be displayed in the sales/region language.
