Background Information  

The United States imposes stringent safety certification requirements for children's products. Domestic manufacturers and importers must test their products in CPSC-recognized third-party laboratories and obtain a CPC certificate before selling them in the U.S. market.  

 

Recently, U.S. Customs has intensified interception of non-compliant children's products. In response, TEMU has updated its cpc compliance standards, requiring sellers to register a U.S. agent (US Authorized Representative).

New cpc certificate Requirements  

1. Scope of Application:  

- Products intended for children under 14 years old and manufactuRED outside the United States.  

 

2. New RULes:  

- CPC certificates must include the U.S. agent information in the `Identification of the domestic manufacturer or importer certifying compliance of the product` field.  

- U.S. agent information should include:  

  - Name, address, and phone number.  

- The U.S. agent must be authentic and valid; fake agencies are prohibited.  

 

3. Effective Date:  

- From December 18, 2023, new products lacking U.S. agent information will be removed from the TEMU U.S. site.

 

Definition and Role of a U.S. Agent  

1. What is a U.S. Agent?  

A U.S. agent (United States Authorized Representative) is an entity registered in the United States responsible for communication with regulatory agencies and handling emergencies to ensure the compliance of imported products.  

 

2. Roles and Responsibilities:  

- Ensure that products comply with U.S. regulations and standards;  

- Assist in product registration and legal sale in the U.S.;  

- Respond to emergencies and communicate with regulatory agencies;  

- Provide product safety and compliance information;  

- Assist with inspections, document submissions, and problem resolution.  

 

3. Requirements for a U.S. Agent:  

- Must be a stable institution or company operating in the U.S.;  

- Have a physical office capable of receiving phone calls and letters during U.S. business hours;  

- Cannot use only email, voicemail, or a personal address.

 

How to Fulfill U.S. Agent Compliance  

1. Engage a Compliance Service Provider:  

Sellers can contact professional agencies (e.g., China JJR Lab) to register a U.S. agent, saving costs while ensuring compliance.  

 

2. Update the CPC Certificate:  

- Submit U.S. agent details (name, address, phone) to the CPC issuing body;  

- Update the relevant fields in the CPC certificate to include U.S. agent information;  

- Upload the updated CPC certificate to the TEMU platform.  

 

3. For Existing Certificates:  

- CPC certificates already uploaded must also include U.S. agent information;  

- No changes are required to the product packaging.

 

New Traceability Label Requirements  

1. Scope:  

- Starting December 2023, products without traceability labels will be removed from the TEMU U.S. site.  

 

2. Definition of Traceability Labels:  

Required for products intended for children aged 12 and under, the labels must be permanently marked on the product itself and include:  

- Manufacturer or private labeler name;  

- Production location (real and valid address);  

- Production date;  

- Batch code or detailed manufacturing process information;  

- Any additional information for product traceability.  

 

3. Key Points:  

- Labels must be permanent and not easily removable;  

- If the product is too small for direct marking, the packaging must include the required information.

 

CPC Certificate and Testing Report Requirements  

1. CPC Certificates Must Include:  

- Product information (name, description, color, etc.);  

- Manufacturer or importer information;  

- Contact details of the certificate holder;  

- Production date and location;  

- Testing date, location, and third-party laboratory details.  

 

2. Testing Report Requirements:  

- Reports must be complete and include:  

  - Product details, applicable standards, results, and sample images;  

  - Testing standards covering both general and specific requirements.

- With stricter regulations, sellers must closely adhere to safety and compliance standards for children's products.
