US CPSC eFiling Electronic Filing Compliance Guide

In accordance with the latest joint requirements issued by the U.S. Consumer Product Safety Commission (CPSC) and U.S. Customs and Border Protection (CBP): Starting from July 8, 2026, all imported consumer products regulated by the CPSC must complete electronic filing (eFiling) via the Automated Commercial Environment (ACE) system. Product compliance certificates and relevant data shall be submitted in advance prior to the arrival of goods.

 

The new regulation covers more than 600 HTS tariff codes and a wide range of product categories, including most consumer products sold via cross-border e-commerce and traditional trade. The core rule is clear: all products under CPSC supervision are mandatorily required to complete eFiling without exception, regardless of goods value, transportation mode or declaration channel.

Seven Mandatory Data Elements for eFiling

 Product ID (GTIN/UPC/SKU, etc.)

 Applicable CPSC safety standards / regulation numbers

 Identification of the certification body

 Contact information (party in custody of test records)

 Production date and production location

 Test date and test location

 Product ID (GTIN/UPC/SKU, etc.)

Important Note: If there are substantial differences between products, or if a certification body determines that product discrepancies may affect compliance, a separate eFiled certificate shall be issued for each individual product. For sellers with numerous SKUs and frequent product updates, this will significantly increase the complexity of backend data management.

 

After the implementation of the new rule, goods with improperly formatted certificate submissions or inconsistent information may face customs clearance delays and denial of release by CBP. With only over one month left before the mandatory enforcement of CPSC eFiling, most importers are concerned about a key question: Do my products need to go through eFiling?


Which Products Are Subject to Mandatory eFiling?

Importers shall first clarify the core definition: CPSC eFiling requirements apply to all CPSC-regulated consumer products that require product certification, not merely products listed on the CPSC-released HTS list.

 

In other words, any product bound by CPSC mandatory safety rules (e.g. cpsia, relevant clauses in 16 CFR) must complete eFiling, whether its HTS code appears on the list or not. It is the importer’s responsibility to determine whether their products fall under CPSC regulation and submit electronic certificate data as required.


Explanation on CPC and gcc certificates

Two types of compliance certificates are required based on product categories:

 Children’s products for ages 12 and under: Children’s Product Certificate (CPC) is required.

 General consumer products (non-children’s products): General Certificate of Conformity (GCC) is required.

 

The latest version of CPSC guidelines for electronic compliance certificate submission and the supporting HTS list cover approximately 600 HTS codes for high-risk products or items subject to mandatory standards. Two key reminders are specified below:

1. The HTS list is not exhaustive. Products outside the list still need eFiling if they are regulated by CPSC and require CPC/gcc certificates.

2. eFiling obligation is determined by product attributes rather than HTS codes. For example, products not on the list but with potential risks of lead, phthalates or small parts may still be required to file. Certain categories will be automatically flagged by the system after the new rule takes effect.

Re-emphasis: The CPSC HTS list does not include all products that require eFiling. It is only a reference tool to help importers identify high-risk goods.

 Products on the HTS list: The system will send automatic reminders, and eFiling is mandatory.

 Products not on the HTS list: eFiling exemption cannot be confirmed automatically. Self-assessment is needed to verify CPSC jurisdiction.

It is recommended that all importers promptly use the Regulatory Robot on the official CPSC website or consult the professional testing institution JJR LAB to confirm if their products comply with CPSC safety standards and determine the necessity of eFiling.


Main Regulated Product Categories & Corresponding HTS Codes

1. Children’s Products

Corresponding HTS Codes: Chapter 9503, 9504, 9401, 9404, etc.

Covered Products:

 Infant products: Cribs, strollers, safety gates, pacifiers, child safety seats

 Children’s apparel & home goods: Kids’ furniture, children’s sleepwear, children’s clothing, kids’ accessories

 Toys: Dolls, electric toys, puzzles, art paints, inflatable toys


2. Apparel / Textiles

Corresponding HTS Codes: Chapter 61, 62, 65

Covered Products:

 Full-range apparel: Adult & children’s clothing, sleepwear, underwear, swimwear, outerwear

 Accessories & home textiles: Hats, scarves, gloves, curtains, bed linens


3. Furniture / Home Goods

Corresponding HTS Codes: 9401 (Seats), 9404 (Mattresses), 9403 (Furniture)

Covered Products:

 Furniture: Mattresses, sofas, children’s beds, bunk beds, tables and chairs

 Home & building materials: Carpets, floor mats, curtains, drywall

 High-risk goods: Lighters, candles, fireworks, coatings (flammable / chemical hazards)


4. Consumer Electronics / Battery Products

Corresponding HTS Codes: 8543, 8504, 8507, etc.

Covered Products:

 Power supplies & batteries: Chargers, power adapters, lithium batteries, power banks

 Button battery embedded products: Items with button batteries (watches, toys, LED cups)

 Electric appliances: Small household appliances, power tools, lawn mowers, hair dryers


5. Sports / Outdoor / Cycling Products

Corresponding HTS Codes: 9506 (Sports equipment), 8712 (Bicycles)

Covered Products:

 Cycling goods: Bicycles, e-bicycles, helmets, protective gear, skateboards

 Outdoor & leisure goods: Pool supplies, water toys, camping equipment


6. Other High-Risk Categories

Covered Products:

 Infant & pet supplies: Baby care products, pet crates (non-children’s use)

 Plastic storage items: Trash cans, storage boxes, plastic containers

 Building products: Architectural glass, pool drain covers (anti-laceration / anti-drowning)

6 Key Compliance Self-Checks (Recommended for Immediate Implementation)

With merely over one month remaining before the new rule comes into force, it is advised that all enterprises take immediate action. Verify the compliance status of all SKUs exported to the United States, complete product testing with professional testing institutions, and conduct trial eFiling on the CPSC system during the voluntary period.

1. Clarify product jurisdiction: Confirm that products are not regulated by other federal agencies such as food, drugs and motor vehicles authorities.

2. Complete compliance certificates: Sort out existing test and certification documents, and match certificates with corresponding product categories. Apply for CPC/GCC certificates in a timely manner if missing, and ensure all certificates are valid and within the expiry date.

3. Unify documents across all links: Keep product test reports, compliance certificates, foreign trade contracts, commercial invoices, customs clearance documents, declarant information and consignee information fully consistent.

4. Complete product registration in advance: Finish registration before the deadline to avoid system congestion during the peak period. Reserve sufficient time for review to prevent unsuccessful registration near the effective date.

5. Confirm formal customs clearance & filing channels: Coordinate with cooperating customs brokers and U.S. freight forwarders to confirm access to the official CPSC eFiling channel. Clarify filing procedures, document requirements and customs clearance coordination rules.

6. Roll out new rules across the supply chain: Promulgate the new regulation to all departments and upstream & downstream partners. Unify standards for production, quality inspection, order acceptance and delivery. Ensure full-link compliance with CPSC requirements from the source.
