About the EU General Product Safety Regulation (gpsr)

The General Product Safety Regulation (GPSR) is established on the basis of market supervision regulations and provisions of other existing EU directives and regulations, replacing the General Product Safety Directive (GPSD). Most non-food consumer goods sold in the EU and Northern Ireland are required to meet the requirements of this regulation, excluding the following product categories:

① Human or veterinary medicinal products;

② Food;

③ Animal feed;

④ Living plants and animals (including genetically modified organisms and genetically modified microorganisms used in a contained manner, as well as products derived from plants and animals directly related to their future reproduction);

⑤ Animal by-products and derived products;

⑥ Plant protection products (e.g., pesticides);

⑦ Consumer transport or travel equipment, provided that the equipment is directly operated by the service provider within the scope of the transport service provided to consumers, rather than by the consumers themselves;

⑧ Aircraft;

⑨ Antiques.

 

How to Comply with EU GPSR(图1)


GPSR to Be Enforced on December 13, 2024

Sellers operating on European platforms should note that although the new General Product Safety Regulation (GPSR) will only take effect on December 13, 2024, compliance with GPSR involves multiple requirements, including information uploading and product labeling. Sellers generally need a certain period of time to complete these three steps and stock goods that meet gpsr labeling requirements in Amazon FBA warehouses. If compliance procedures are initiated only after the regulation takes effect, non-compliant products will face the risk of being immediately removed by Amazon. Therefore, we recommend that you start the GPSR compliance process 3-4 months in advance.

 

How to Achieve GPSR Compliance?

Step 1: Register an EU Responsible Person for Your Non-Food Products

An EU Responsible Person refers to a natural or legal person explicitly designated by a manufacturer outside the European Economic Area (EEA). It can be a local manufacturer or importer, or an Authorized Representative (AR) designated by the manufacturer or brand within the EU.

 

For sellers located outside the EU, the eu authorized representative will act on their behalf to fulfill specific obligations imposed by relevant EU directives and laws.

 

Sellers who do not have a subsidiary or EU importer may contact third-party testing laboratories/certification bodies to complete the EU Authorized Representative registration. It is generally more professional and reliable to select third-party compliance testing providers listed in the Amazon Service Provider Network.

 

Step 2: Redesign Product Labeling if Necessary, Ensuring Labels Include (But Are Not Limited To) the Following Information

① Contact details of the Responsible Person and manufacturer (name, postal address, email address/URL, telephone number);

② Product safety and warning information, including ce marking, energy labels, toy safety warnings, and chemical hazard warnings (in the language of the country where the product is sold);

③ Product type, batch number, serial number, or other information facilitating product identification.

 

Labels can be affixed to the product, product packaging, product parcel, or accompanying documents. A QR code/barcode may be added to the label to display the Responsible Person/manufacturer information. Meanwhile, sellers must also present the Responsible Person/manufacturer information in text form on the product, product packaging, or accompanying documents.

 

Step 3: Upload Required Information to the Seller Platform in a Timely Manner

① EU Responsible Person information;

② Manufacturer and importer information (if applicable);

③ Product safety and warning information (in the language of the country where the product is sold).
