④ Food Contact Materials (FCM) Testing

EU Tobacco Products Directive (TPD)

The Tobacco Products Directive (TPD) is a regULation governing and supervising the manufacturing, sales, and presentation (including product design and packaging) of all tobacco and tobacco-related products (e.g., e-cigarettes). Currently, in most EU member states, e-cigarettes are regulated and managed as recreational consumer products. Since 2016, e-cigarettes and related products have been subject to the provisions of Article 20 of the TPD.

 

A. Key Contents to Be Included in the Product Electronic Notification:

(1) Manufacturer’s name and contact information

(2) IngREDient list and release content

(3) Toxicological data

(4) Nicotine dosage intake information

(5) Description of product composition and production process

(6) Declaration of product quality and safety responsibility

 

B. Requirements for E-liquid and Reservoirs:

E-liquid containing nicotine may only be placed on the market in specialized refill containers with a volume not exceeding 10mL. For disposable e-cigarettes or single-use pods, the volume of the pod or reservoir must not exceed 2mL.

 

C. Requirements for Nicotine:

(1) The nicotine content in nicotine-containing e-liquid must not exceed 20mg/mL.

(2) Under normal usage conditions, the nicotine release rate of e-cigarettes shall be maintained at a stable level.

 

D. TPD Testing Requirements for E-cigarettes:

Testing shall be conducted to determine the content of the following cheMICal substances in the aerosol emitted by e-cigarettes. For e-cigarette products without e-liquid, only the first 3 items are required; for products with e-liquid, all 7 items must be tested.
