Sellers must pay close attention and promptly arrange professional U.S. representative services to effectively avoid potential risks such as customs seizures or forced product removal. Starting from April 2025, listing products on Amazon or TEMU under CPC Certification requires a U.S. Authorized Representative (U.S. AR)!
A U.S. Authorized Representative (U.S. AR) is an entity designated according to U.S. FDA, FCC, CPC, and other relevant regULations. Sellers of medical devices, cosmetics, food, drugs, laser products, wireless products, children’s toys, maternal and infant products, and similar goods must complete the registration process and appoint a U.S. AR before entering the U.S. market.
- Handle emergency situations and routine communications.
- Must have a physical business location in the U.S.
- Must be able to answer calls or receive mail during regular business hours.
- Locations that only have email, voice mail, or personal addresses are not acceptable.
Foreign sellers in the fields of medical devices, cosmetics, food, drugs, alcohol, laser products, etc., must complete FDA registration and designate a U.S. AR before selling in the U.S. market. Specific categories include:
- Medical Devices:From simple consumables to complex large-scale medical equipment.
- Cosmetics:Skincare, makeup, haircare products.
- Food:Fresh produce, processed foods, beverages.
- Drugs:Prescription and over-the-counter medications.
Foreign sellers of radio products requiring FCC certification—such as WiFi devices, Bluetooth devices, mobile phones, computers, radio transmitters/receivers, and remote-controlled toys—must appoint a U.S. AR.
Applicable mainly to products intended for children aged 12 and under, such as toys, cradles, carriers, and children’s clothing. Non-U.S. manufacturers must designate a U.S. AR and include its information in the CPC certificate before entering the U.S. market.
Foreign sellers of pesticide products (e.g., insecticides, rodenticides, herbicides) and pesticide devices (e.g., UV devices, insect traps) must register a U.S. AR.
Products requiring energy labeling—such as TVs, refrigerators, freezers, washing machines, and indoor air conditioners—also require a U.S. AR if the manufacturer is outside the U.S.
