What is EPA?

EPA stands for Environment Protection Agency, which is responsible for investigating and formULating national environmental standards. It grants relevant licenses on behalf of states and departments, monitors compliance, and enforces regulations. Authorized by federal law, the EPA regulates products that impact the environment, such as diesel engines, gasoline engines, toxic substances, and pesticides.

 

Background of Registration

On February 15, 2018, the U.S. Environmental Protection Agency (EPA) REACHed a settlement with Amazon over more than 2,000 cases of unregisteRED and unlabeled pesticide product distributions between 2013 and 2016.

 

According to the agreement:

- Amazon agreed to pay an administrative fine of $1,215,700 and take measures to regulate and remove illegal pesticides from its platform.

- Since then, Amazon has strengthened regulatory oversight to eliminate potential violations related to pesticide/pesticide equipment.

- Starting in June 2018, Amazon began forcing the removal of non-compliant pesticide/pesticide equipment from its platform until they became compliant.

- In January 2019, Amazon officially implemented new regulations, requiring that all products must obtain an EPA registration number; otherwise, they cannot be listed on Amazon’s U.S. platform.

 

Thus, sellers must complete EPA registration in advance to ensure the legal sale of their products.

 

Common Devices Regulated by the EPA

According to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), any device that is used for sterilization, disinfection, inactivation, or trapping harmful organisms—such as insects, rodents, birds, bacteria, fungi, and MICroorganisms—must be registered with the EPA before being sold in the United States.

 

Common regulated devices include:

- UV disinfection lamps

- Ozone disinfectors

- UV sterilizers

- UV mosquito killer lamps

- Ultrasonic pest repellers

- UV water purifiers

- UV air purifiers

- High-frequency bird repellers

- Electronic rodent repellers

2. Apply for a Company Number

3. Apply for an Establishment Number

4. Submit the initial annual report within one month of successful registration

5. Submit EPA Form 3540-1 for customs clearance during export

6. Submit the previous year's report before March 1 of the following year

 

Important Considerations

- EPA registration must be applied for by a U.S. resident or company.

- Foreign companies (such as manufacturers in China) cannot apply directly.

- They must authorize a U.S. agent to apply on their behalf.

- The U.S. agent must be either a permanent U.S. resident or an EPA-authorized agency.

 

How Does the EPA Regulate?

1. Simple product types (those that do not rely on chemicals to function)

 - Do not require a certificate. However, after registering the company and factory information, the EPA will issue a notification letter.

 

2. EPA does not require product effectiveness reports but does conduct regular inspections of product labels

 - Manufacturers must design product labels according to EPA regulations.

 - Applicants must submit their previous year's sales report within 30 days of receiving the registration number.

 - Starting from the second year, the annual report must be submitted before March 1 every year.

 

3. Labeling Requirements

 - Manufacturers must place insecticidal and antibacterial product labels prominently on packaging and instruction manuals.

 - Labels must indicate that the product complies with EPA requirements and display the EPA Establishment Number.

 - Product performance must be clearly and accurately stated. Misleading or deceptive claims, formats, or graphics are strictly prohibited.

 - Copying or using another product’s name is strictly prohibited. All essential product information must be explicitly stated.

 

Validity of EPA Registration

EPA registration does not have a specific expiration date. As long as:

- Annual production reports are submitted on time

- The authorized U.S. agent remains legally valid

 

The EPA registration remains continuously effective.
