What is Prop 65 Warning?

The official name of Proposition 65 is the Safe Drinking Water and Toxic Enforcement Act of 1986. This California law requires warnings to be provided to California consumers when they will be exposed to cheMICals identified by California as causing cancer or reproductive toxicity. These warnings aim to help California consumers make informed decisions about the chemicals they may encounter when using products. The Office of Environmental Health Hazard Assessment (OEHHA) administers the Proposition 65 program and publishes a list of registeRED chemicals, which now exceeds 850. In August 2016, OEHHA adopted new regULations that took effect on August 30, 2018, modifying the information required in Proposition 65 warnings.

 

What is Proposition 65?

In 1986, California voters approved the Proposition 65 initiative in response to growing concerns about exposure to toxic chemicals. Officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, this law mandates California to publish a list of chemicals known to cause cancer or reproductive toxicity. Businesses with 10 or more employees must provide warnings when they intentionally cause significant exposure to listed chemicals.

 

The list currently includes over 900 chemicals. Proposition 65 does not ban or restrict the sale of chemicals on the list. These warnings are designed to help Californians make informed decisions about exposure to these chemicals when using products or visiting places.

OEHHA is responsible for administering the Proposition 65 program.

 

Amazon US Requirements:

You are responsible for complying with all applicable laws, including the warning requirements under California Proposition 65 (Prop 65). For all existing and new product listings, you must:

① Determine if your product requires a Prop 65 warning.

② Provide the correct Prop 65 warning to Amazon using the instructions on this page (do not use any other methods such as email).

③ Contact Seller Support if a court requires you to provide a custom Prop 65 warning for your product.

④ If you are not the manufacturer of the listed product, provide us with the Prop 65 warning you received from the product manufacturer.

⑤ Do not provide us with any warning materials (such as labels, signs, shelf tags, or hangtags) to be displayed with your product unless we specifically request it in writing.

⑥ Provide the Prop 65 warning for any applicable child SKUs. If you provide a Prop 65 warning for a parent SKU, you will receive an error message and your submission will fail.

If your product itself, its container, or packaging is printed or labeled with one of the following product warnings, you must select one of the following warning types and must not select chemical names:

If the product is an alcoholic beverage, log, passenger car or off-highway vehicle, recreational vessel, or contains a diesel engine, you must select the relevant warning type and must not select chemical names:

How to Provide Prop 65 Warnings for Your New and Existing Products:

When creating single or multiple product listings in Seller Central, use the following methods to provide Prop 65 warnings.

 

Creating a Single Product Listing in Seller Central:

① Go to Inventory, then select Add a Product.

② Click Create a new product listing.

③ Navigate to the Compliance tab, then select the appropriate California Proposition 65 warning type and, if applicable, the relevant California Proposition 65 chemical name(s). Refer to the table below for various warning types and the warnings that will be displayed for each type.

 

Creating Multiple Product Listings in Seller Central:

① Go to Inventory, then select Add Products via Upload.

② Select the applicable product category and generate an advanced template.

③ In the template, you will find the California Proposition 65 attributes under the Compliance group section. Select the appropriate California Proposition 65 warning type and, if applicable, the relevant California Proposition 65 chemical name(s).
