2009/48/EC Toy Safety Directive

The Toy Safety Directive (2009/48/EC) is the core regulation for toy market access in the European Union. It regulates the safety of toys — preventing hazards such as choking, cuts, poisoning, and other injuries. All toys sold in the EU must comply with this directive. The new Toy Safety Regulation (EU) 2025/2509 has been published and will fully replace the old directive in 2030.


Definition of Toys (Directive 2009/48/EC)

Toys are defined as products designed or intended, whether or not exclusively, for use in play by children under 14 years of age.

  • Common Toys: Plush toys, plastic dolls, building blocks, puzzles, rattles, electric toys, remote control cars, scooters, etc.

  • Not Considered Toys: Christmas decorations, sports equipment (not exclusively for children), collectibles (clearly labeled as not suitable for children under 14), and decorative accessories on children's clothing (without play functions).


Core Safety Requirements of the Toy Directive

Flammability testing for plush toys, children's wigs, and masks.

Migration of 19 heavy metals (en 71-3), Phthalates (6 types, each ≤ 0.1%).

Electrical Safety

Electric toys must comply with EN 62115 (battery safety, temperature rise).

Hygiene Requirements

Cleanliness of plush toy stuffing, textiles must be odorless.

Warnings and Labeling

ce mark, applicable age range, choking hazard warnings.

Why are the requirements for toys for children under 3 years old particularly strict?

A: Children under 3 are in the "oral stage" and are prone to putting small parts in their mouths; therefore, any small parts are strictly prohibited to prevent choking hazards.


Do plush toys need flammability testing?

A: Yes. All toys with a textile surface must comply with the EN 71-2 flammability test.


What are the costs and lead times for Toy CE Certification?

A: A full set of EN 71 tests for standard plastic toys costs approximately $698 to $1,300, with a turnaround time of 7-10 days. Electric toys require additional testing under EN 62115.
